Terms & Conditions
The contract is between Oggys Cakes and “you” (the purchaser of the cake). By placing an order with Oggys, through any form of contact, you agree to these terms.
The Terms and Conditions are what sets our agreement and any change must be agreed in writing by both parties. When placing an order written/emailed confirmation will be provided. Please check this carefully and notify Oggys Cakes within 3 days of the date of the order, if anything is incorrect.
Cakes can be collected from Lichfield, Staffordshire at an agreed date and time.
The cake may contain nut traces. We cannot guarantee that products used are nut free or not prepared in a facility that also makes nut products.
The cake may contain wires and other non-edible products. It is yours or your caterer’s responsibility to ensure that these non-edible products are removed before serving the cake to yourself or your guests.
Oggys Cakes will try to match your requested colour but all cakes are individual and handmade so slight differences may occur. We reserve the right to use our judgement when designing and making your cake, and therefore may need to adjust your order slightly.
Oggys Cakes is a registered and home based so visits are by appointment only. Please contact us to arrange an appointment if you prefer to discuss your order in person. This is recommended for weddings.
We usually need 4 weeks notice to create a celebration cake (6 months for a wedding cake) but to secure your required date and to avoid disappointment we would advise you to place your order as soon as possible, alternatively a small deposit can be made to ensure that your date is held.
Deposit & Payment
A 50% deposit is required for orders priced at £50 or above. The final balance for your cake is then payable in cash on collection. Payment is required in full for cakes/cupcakes priced below £50. If the deposit is not received within 48 hours of placing your order Oggys Cakes will not hold your date or proceed with your order.
For any order with a lead time of 2 weeks or less payment will be required in full on day of ordering. All deposits are non-refundable but may be transferred depending on circumstances and our availability. Payment is accepted by cash or direct bank transfer.
If you have to cancel your order for any reason, you will be liable for any costs we have incurred in excess of the deposit already paid. In addition, if a wedding cake is cancelled within 4 weeks of the wedding date, the full outstanding balance will still be payable – if we take another order of similar value we will refund the deposit but not the cost of any items purchased specifically for your event unless they can be used for something else.
If Oggys Cakes have to cancel due to unforeseen circumstances (eg illness) then a full refund will be given.
You have a duty to inform Oggys Cakes of any allergies such as needing dairy free, gluten free etc. Cake generally has allergens present. If you require a full ingredient list for your particular order please ask.
The 14 allergens which must be advised are: gluten, crustaceans, molluscs, eggs, fish, peanuts, nuts, soybeans, milk, celery, mustard, sesame, lupin, and sulphur dioxide at levels above 10mg/kg, or 10 mg/litre, expressed as SO2.
The allergens present in Oggys made cakes are usually:-Gluten, wheat. Eggs .Nuts/peanuts if requested – i.e. peanut butter frostings, fruit cakes etc. Sulphur dioxide at very low levels can be found in dry fruits, jam, conserves, etc. Milk.
Oggys Cakes cannot guarantee any product made by them or bought in does not contain nut traces. Oggys Cakes follow a strict cleaning process before and after every bake to avoid cross-contamination but as Oggys Cakes have used nuts in the kitchen it cannot be classed as a nut free environment.
Oggys Cakes will take every care with allergies but they cannot stop people eating it so please advise anyone who has food allergies to be aware.
Once the cake has been collected/delivered, it is no longer the responsibility of Oggys Cakes and we cannot be held liable for any interference or damage to the completed cake.
No liability will be taken by Oggys Cakes for any omissions or errors on a cake if it is not viewed by you at an agreed time before collection/delivery.
Oggys Cakes does not accept liability for indirect or substantial loss suffered.
In the unusual event that you are not entirely happy with your cake you must return it, un-eaten, to Oggys Cakes within 24 hours or sooner if possible. You must also provide your comments in writing at the time of return stating the area(s) of concern. No refund/goodwill gesture will be offered until a full investigation has been carried out by Oggys Cakes or relevant Food Standards Agency.
Storage & Transportation
Cakes should be stored in a cool dry place in the box they were supplied in. Do not refrigerate your cake as it may cause colours to run, decorations to wilt and the sugarpaste to go sticky.
It is recommended you transport the cake on a piece of non-slip matting in the boot of a car to keep it flat and less likely to slide. Please keep the interior of the vehicle cool.
Oggys Cakes does not store the financial details of clients
GDPR – Data Protection
When placing an order your personal details will be stored but only for use by Oggys Cakes. They will not be distributed to a third party.
